Who Needs to Remove Conditions On a Green Card?

If you received a two-year conditional green card through marriage to a U.S. citizen or lawful permanent resident, you'll need to file Form I-751 to remove those conditions and secure your permanent residence.

Who Files Form I-751?

The primary applicant for Form I-751 is the conditional permanent resident. This includes spouses who received their status through marriage. In most cases, you will file the form jointly with your U.S. citizen or lawful permanent resident spouse.

The petition can also include your dependent children if they received their conditional permanent resident status at the same time as you or within 90 days of your status being granted. If a child was not included on the parent’s petition, they may be able to file a separate I-751.

Waivers of Joint Filing and Special Circumstances
